A LEGAL DISCLAIMER

The Sweet Side of Gi, operated by Giana Simonelli, makes every effort to ensure products are prepared, packaged, and delivered with care. However, by placing an order, you acknowledge and accept the following:

Allergen Warning: Our products are made in a facility that handles common allergens, including but not limited to nuts, dairy, eggs, gluten, and soy. While accommodations may be requested, cross-contamination is possible, and we do not guarantee allergen-free products.

Product Liability: Once goods are picked up or delivered, The Sweet Side of Gi is not responsible for damage due to improper handling, storage, transport, weather exposure, or failure to follow care instructions.

Design Variations: While we strive to match design requests, exact replicas are not guaranteed. Artistic interpretation, ingredient availability, and technical limitations may result in variations.

Deposit Policy: All deposits are non-refundable. Changes or cancellations are subject to the terms outlined in the Terms & Conditions.

Limitation of Liability: Our maximum liability for any claim, including product defect or delivery issue, is limited to the original purchase price of the item(s) in question.

By completing your order, you confirm that you have read, understood, and agreed to this disclaimer and all related policies.

TERMS & CONDITIONS

1. Orders
Smaller Orders: Require at least 1 week notice.
Larger Orders: Require at least 2 weeks notice.
Rush Orders: May be accepted depending on quantity and availability. A rush fee will apply.
Orders are confirmed only after a deposit is received and accepted by Giana Simonelli.
2. Delivery & Pick-Up
Delivery/pick-up arrangements will be confirmed at the time of order.
Pick-Ups: Clients have a 15-minute grace period. Please notify in advance if delayed.
Deliveries: Will be scheduled within a 30-minute window to accommodate multiple stops.
Deliveries may be made by Giana Simonelli or an authorized delivery driver.
Once the order is picked up or delivered, The Sweet Side of Gi is not liable for any damage, mishandling, or spoilage.
Tips are appreciated, but not required.
3. Cancellation Policy
Cancellations must be made no later than 48 hours before your pick-up or delivery time.
All deposits are non-refundable under any circumstances.
At the sole discretion of Giana Simonelli, deposits may be transferred to a future order.
4. Changes to Orders
Additions may be made up to 1 week before the event date, pending approval.
A 50% deposit will be required for any additional items.
Removals may be made up to 1 week (168 hours) before the event.
Reductions will not result in a refund or credit of any deposit amount.
5. Storage & Handling
Cake Pops:
Safe for up to 1 week at room temperature
Up to 4 weeks refrigerated
Up to 3 months frozen
Avoid exposing chocolate-dipped treats to heat or direct sunlight, as they may melt.
Do not stack boxes, especially those containing Cake Pops, to avoid cracking or crushing.
6. Rental Displays
Rental prices vary and are due with the final payment.
Removal of rental items from your order must be requested at least 24 hours in advance.
Rented items must be returned within 72 hours unless a $20 Break-Down Fee is paid for pick-up service.
7. Dessert Bundles
Require a 50% non-refundable deposit at booking.
Final payment due 1 week prior to the event.
Setup Fee: $30 (optional)
If using rental displays:
You may return them yourself, or
Pay a $20 Break-Down Fee for pickup.
8. Allergens & Dietary Needs
It is the customer’s responsibility to disclose all allergies at the time of order.
Accommodations will be made, but cross-contamination is possible.
The Sweet Side of Gi is not liable for allergic reactions under any circumstances.
Customers are encouraged to inform guests of potential allergens in the products.
9. Liability
Once a product is delivered or picked up, the customer assumes full responsibility.
We are not responsible for:
Environmental damage (e.g., heat, transport issues)
Storage errors
Mishandling by client or third parties
Allergic reactions, even if allergies were disclosed
Customers should inspect products at the time of handoff.
Porch pick ups and deliveries release all liability once the product is left at the premises.
10. Intellectual Property
All designs, images, logos, and content provided by or through The Sweet Side of Gi remain the sole property of Giana Simonelli and may not be copied or reused without written permission.
11. Dispute Resolution & Governing Law
These Terms shall be governed by the laws of the State of New Jersey
In the event of a dispute, both parties agree to attempt mediation prior to taking legal action.
Any legal claim must be filed in a court located in Monmouth County, New Jersey.
12. Updates to Terms
These Terms may be updated at any time. Updates will be posted on the website.

Continued engagement constitutes agreement with the revised terms.
